Terms of Service and Terms of Sale
The contract covering use of the PixHaste website and purchases made from it.
1. Agreement to These Terms
These Terms of Service and Terms of Sale (“Terms”) govern access to and use of the PixHaste LLC website and purchases made directly from PixHaste LLC (“PixHaste,” “we,” “us,” or “our”). By using the Site or placing an order, you agree to these Terms and to the Digital Delivery and Fulfillment Policy, Refund, Cancellation and Replacement Policy, and Privacy Policy.
If you do not agree to these Terms, do not use the Site or place an order.
2. U.S.-Only Store and Customer Eligibility
The Site and its sales are intended for customers located in the United States. PixHaste does not knowingly accept orders from customers located outside the United States.
You must be legally capable of entering into a binding contract in your state. A person who has not reached the age of majority in their state can place an order only with the involvement and permission of a parent or legal guardian.
3. What We Sell
PixHaste sells licensed digital video game activation keys and related digital entitlements for supported gaming platforms. No physical product is shipped.
A purchase provides the customer with the right to use the activation key and associated digital content under the product description, publisher terms, platform terms, license restrictions, and region restrictions shown before purchase. The purchase does not transfer ownership of the underlying game software, intellectual property, trademarks, artwork, or other proprietary rights.
4. Product Information and Compatibility
Before ordering, customers are responsible for checking the game title, edition, platform, activation method, system requirements, language, and region shown on the product page. A key intended for one platform, edition, or region can fail to work on another.
PixHaste takes reasonable steps to keep listings accurate. When a material pricing, availability, or description error is identified before fulfillment, PixHaste can cancel the affected order and return the amount charged to the original payment method.
5. Orders and Acceptance
Submitting an order is an offer to purchase. An automated order confirmation only confirms receipt of the order. Acceptance occurs when PixHaste fulfills the order or otherwise confirms acceptance.
Orders are subject to payment authorization, fraud screening, product availability, and legal compliance. PixHaste can decline or cancel an order for suspected fraud, unauthorized payment activity, legal restrictions, obvious pricing errors, duplicate orders, technical errors, or product unavailability. A paid order canceled before fulfillment will be refunded.
6. Prices, Taxes, and Payment
Prices are displayed in U.S. dollars unless the Site states otherwise. Applicable sales, use, or similar taxes are added when required by law. Any charge imposed by PixHaste is disclosed before the customer submits the order.
Customers must use a payment method they are authorized to use and must provide accurate billing information. Payments are processed by third-party payment providers. The payment provider available at checkout processes payment information under its own terms and privacy notice.
7. Digital Delivery
All products are delivered electronically. The activation key is delivered using the electronic delivery method shown during checkout or in the order confirmation. No physical item is shipped.
Delivery timing can be affected by payment authorization, fraud screening, technical availability, and product availability. The Digital Delivery and Fulfillment Policy contains additional details.
8. Activation and Third-Party Gaming Platforms
Activation keys are redeemed through the gaming platform or service identified on the product page. Those services are operated by third parties and can require a separate account, software installation, internet access, or acceptance of their own terms.
PixHaste does not control third-party gaming platforms, publisher servers, platform outages, account suspensions, publisher updates, or changes to third-party services. PixHaste is not responsible for an inability to use a valid key caused by a customer account restriction, device incompatibility, failure to follow activation instructions, violation of third-party terms, or another circumstance outside PixHaste control.
9. Personal End-User Use and No Unauthorized Resale
Products sold through the Site are intended for the purchaser as an end user unless PixHaste agrees otherwise in writing. Customers must not use the Site or products for unauthorized commercial resale, sublicensing, bulk redistribution, fraud, money laundering, payment testing, account trafficking, or any activity that violates law or third-party rights.
Customers must not manipulate, duplicate, generate, reverse engineer, steal, or unlawfully obtain activation codes or other digital entitlements.
10. Refunds, Cancellations, and Defective Keys
Digital products are governed by the Refund, Cancellation and Replacement Policy. Because an activation key cannot be physically returned after disclosure or delivery, completed digital deliveries are generally final except when the key is invalid, previously redeemed before delivery, materially different from the product ordered, incorrectly delivered by PixHaste, or when a refund is required by law.
PixHaste can verify the reported issue and provide activation support or a replacement key before issuing a refund when a replacement is appropriate.
11. Fraud Prevention and Order Verification
Orders are subject to automated or manual fraud screening designed to protect customers, rights holders, payment providers, and PixHaste. PixHaste can request reasonable information needed to verify an order before digital delivery. An order that cannot be verified or presents an elevated payment risk can be delayed, declined, canceled, or refunded.
Customers must not submit false, misleading, manipulated, or unauthorized identity, billing, or payment information.
12. Intellectual Property
The Site content owned by PixHaste, including its design, text, graphics, logos, and software, is protected by applicable intellectual-property laws. Game titles, publisher names, platform names, artwork, and trademarks belong to their respective owners and are used only as permitted for product identification, promotion, and distribution.
The availability of a product on the Site does not state or imply that PixHaste is the publisher, developer, platform operator, or owner of the underlying game intellectual property.
13. Prohibited Conduct
Customers must not use the Site for unlawful, fraudulent, deceptive, abusive, or infringing activity. Prohibited conduct includes unauthorized access, interference with security or fraud controls, abuse of checkout through bots or automated tools, testing stolen payment credentials, false payment disputes, intellectual-property infringement, and use of purchased products in violation of applicable publisher or platform terms.
14. Disclaimers
To the maximum extent permitted by law, the Site and services are provided on an “as available” basis. PixHaste does not guarantee uninterrupted access to third-party gaming platforms, publisher servers, payment networks, or internet services.
Nothing in these Terms removes a warranty, remedy, or consumer right that cannot legally be waived.
15. Limitation of Liability
To the maximum extent permitted by applicable law, PixHaste is not liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from use of the Site or a product, including loss of data, loss of opportunity, or interruption caused by a third-party platform.
When liability can legally be limited, PixHaste total liability arising from a particular purchase will not exceed the amount paid to PixHaste for the product giving rise to the claim. This limitation does not apply where liability cannot legally be excluded or limited.
16. Governing Law and Disputes
These Terms are governed by the laws of the State of New Mexico and applicable federal law, without regard to conflict-of-law principles. Subject to non-waivable consumer rights that apply in a customer state, disputes arising from these Terms or a purchase from PixHaste will be brought in a court of competent jurisdiction located in Bernalillo County, New Mexico, or the applicable federal court serving that area.
Before filing a lawsuit, customers are encouraged to contact support@pixhaste.com so PixHaste can attempt to resolve the issue directly.
17. Changes to These Terms
PixHaste can update these Terms by posting a revised version with a new effective date. Changes apply prospectively unless law requires otherwise. The Terms in effect at the time of purchase govern that transaction, except for changes required by law or agreed to by the customer.
18. Severability and Entire Agreement
If a provision of these Terms is held unenforceable, the remaining provisions remain in effect to the fullest extent permitted by law. These Terms and the policies incorporated by reference form the agreement between the customer and PixHaste regarding use of the Site and purchases from the Site, except for a separate written agreement expressly entered into with PixHaste.
